PRO SE PETITION SEEKING LEAVE OF COURT TO REQUEST STATUS HEARING ON PENDING FARETTA PETITION
Now comes Petitioner humbly before this Honourable Court to seek leave of Court in accordance with Locale Rule 2.03 (d) (M.D. Fla.) To request scheduling of Status Hearing on Petitioners July 2004, Pro Se Faretta Petition pending before this Court.
• On July 5, 2005, Senior Circuit Judge Susan Schaeffer for the Sixth Judicial Circuit issued an order giving the State 15 days to set a status conference where Petitioners motions to discharge counsel and waive DNA issue will be heard.
• On July 20, 2005, the State set the date of aforementioned hearing for August 29 th , 2005.
• Petitioner now humbly requests this Court in the best interest of quickly resolving this case issue an order giving the State 15 days to inform this Court as to outcome of aforementioned Status Conference and expeditiously set date if need be for Status Hearing before this Court on Petitioners pending July 2004, Pro Se Faretta Petition. Which Petitioner reserves right to amend.
• Petitioner also humbly request said order include the State arrange for immediate transfer of Petitioner to Tampa Facility so Petitioner can prepare for Status Hearing before this Court.
