My attorneys placed me in a dilemma on May 9th, 2000 during Oral Arguments before the Florida Supreme Court, by arguing something they knew I would never approve of. That was to argue an Intoxication Defense vs. First Degree Murder. This tactic came as a complete surprise to me upon receipt of the transcribed Oral Arguments. It was also surprising to the States Attorney, since it had not been raised before in my appeals.
I feel betrayed at the moment, but also realize there isn't much I can do about it. When I wrote to my attorneys I let them know of my disapproval of this tactic and that I hoped they would take full responsibility if it fails.
Something else I would like to comment on that my attorney failed to bring to light while being questioned by the Court. Both Poole and Borton (the probable killers) initially denied any knowledge of this crime. I can only hope the Court does a thorough review of the record to learn this fact.
Wish me well that my Attorneys gamble of a tactic is successful and the Court grants me a Hearing where the truth can finally be bought to light.
