MY CLOSING STATEMENT

Closing Statement

IN CLOSING - The appelate process does not determine guilt or innocence. The appelate process is to determine whether the Trial was fair or not. State's attorney Bruce Young told the Jury in his closing argument that I received a fair Trial. My attorney could only argue that I maintained my innocence and that the state had the burden of proving guilt. Later Judge Susan Schaeffer would deny me an evidentiary hearing on the Trial issues.

My appeal is now in the Tampa, Florida Federal district court. In the past Judge Susan Schaeffer and state's attorney Bruce Young have argued that I was a problem client — that would not allow my attorneys to do their job of giving me the best possible defence in accordance to the overwhelming evidence as to guilt. They wanted me to change my plea of innocence to one of diminished capacity, which would be an admission of guilt to a lesser degree of murder than the First Degree murder of which I was charged. I refused to do that because I am innocent. Their argument of me being a problem client holds no weight. I have shown through review of the facts in my case that I didn't receive a fair and impartial Trial. My attorney was rendered inept, inadequate and ineffective, due to being denied access to the exculpatory evidence, evidence that the state's attorneys should have had and known about for it is the moral and ethical duty of the state's attorneys to present the facts and only the facts.

I have met the burden of showing I did not receive a fair and impartial Trial. But none of what I have shown through this website means a thing unless I am given an evidentiary hearing on the Trial issues. I have been naive in the past by placing my faith in the legal system to correct itself. I can no longer be so gullible. I am no longer the naive individual that couldn't defend himself against the abuse which I have had to endure all of these years. I realize that you the citizens of Cyberspace are a strong political force. I am NOT paranoid — the state of Florida is really trying to kill me.

I need your help to place the legal system under scrutiny. HELP ME to stop the abuse.
